All participants should act civil and appropriate for a public meeting. All meetings are recorded and a chat transcript is saved. The Committee respects the right of the public to comment on Committee matters. Employees who are defamed by public comment may be entitled to pursue legal action against those who engage in such comments. 

AB 361 SUMMARY

  • Brown Act flexibility extended by AB 361.
  • Provides flexibility (but does not require) to meet remotely or virtually through January 1, 2024.
  • AB 361 provides school district’s Committees with the ability to meet remotely during proclaimed gubernatorial state of emergency that remains active.
  • A real time online destination like a publicly accessible Google Meet stream - video conference (live streaming) is required for each remote meeting.
  • AB 361 requires that public comment be made during the meeting. Comment can include video conference or internet-based service options. This does not prohibit communication (feedback) from being sent in writing advance of the meeting.
  • All votes must be made by rollcall - it is suggested to use the chat feature and each voting member type Y, N or Abstain during the vote to record name and vote.
  • Committee must reaffirm by a majority vote the need for remote meeting(s) every 30 days. Language similar to: The committee has reconsidered the circumstances of the emergency and agrees that the emergency continues to directly impact the ability of the members to meet safely in person so the next meeting will be virtual or reaffirm a resolution if previously passed.
  • If Meetings are more than 30 days apart here is a suggested two meeting process.
  • If Google Meet live stream and/or public comment time is disrupted, the Committee cannot take any further action on any agenda until the technical issue is resolved.

Measure E Citizens’ Bond Oversight Committee (CBOC) Overview

magnify on dollar sign After passage of Bond Measure E, the $650 million General Obligation Bond approved by Fremont voters in the June 3, 2014 election, the Fremont Unified School District Board of Education appointed 11 seats on the Bond Measure E Citizens’ Bond Oversight Committee (CBOC). Members serve either a two- or three-year term. The purpose of the committee is to “actively review and report on the proper expenditure of taxpayers’ money for school construction” on Measure E projects.

The CBOC meetings are typically held the first Wednesday (unless otherwise noted) of each month during the school year.

With the passage of Measure E in June 2014, the Fremont Unified School District (FUSD) invited individuals in the community to serve as volunteers on an Oversight Committee to monitor the use of funds allocated to the District for facility repairs/improvements. The FUSD Citizens’ Bond Oversight Committee (CBOC), which is comprised of volunteers, was first appointed by the District’s Board of Education, in accordance with the requirements of Proposition 39, and following the Board’s certification of the June 3, 2014, Measure E General Bond Election, on September 23, 2014. Last appointments to the CBOC were made on October 13, 2016. Appointments on the CBOC are for two and three years, so applications are accepted on a rolling basis.

"The Citizens’ Bond Oversight Committee has and will continue to play a vital role in overseeing the wide range of facility-improvement and new construction projects Fremont Unified will complete over the coming years thanks to the support of our community," said former FUSD Board Trustee and current Fremont City Councilmember Dr. Yang Shao. 

"There are many members of our community who invested a great deal of time and effort to the Bond campaign," added Board Trustee, Ann Crosbie. "Participating on the CBOC is another opportunity for individuals within our District to help make our schools even better."

CBOC members will receive regular updates on Bond projects and report progress to the FUSD Board of Education. 

Per the requirements of Proposition 39, a bond oversight committee is required to include participants from specific segments of the community. The committee is required to have a minimum of seven members (plus five alternates) and include at least one from each of the following five categories:

  • Active in a business organization representing the business community located within FUSD.
  • Active in a senior citizens’ organization.
  • A parent or guardian of a child enrolled at FUSD.
  • Active in a parent-teacher organization and parent or guardian of a child enrolled at FUSD.
  • Active in a bona fide taxpayers’ organization.
